✧GENERAL✧
✧ Hello! Thank you very much for taking the time to read my T.O.S! I hope you feel comfortable in this space!
✧ By commissioning me, you agree to these terms and conditions.
✧ I have the right to reject any order for any reason.
✧ The majority of commissions will contain my watermark/signature when appropriate (excluding individual emotes, logos, etc).
✧ I do consider NDA requests, and they are on a case-by-case basis.
✧ I require clients to have a visual reference of their character to work from. I will not be designing characters for you. AI art references are explicitly not accepted and you will be blacklisted from commissioning me in the future.
✧ I reserve the right to post the art online in my portfolio, on social media, and in publications to advertise my art and services.
✧ I will not profit further from the commissioned artwork unless you as the customer break these terms as agreed.✧PAYMENTS✧
✧ Payments are due according to the payment plan despite project milestones.
✧ Commissions can be paid either 100% upfront or split 50% upfront (nonrefundable) and 50% after sketch approval to start rendering.
✧ For larger and more complex commissions do not send me payment before I have agreed to take your commission, and requested you to send me the payment.
✧ A commercial license can be obtained if negotiated before payment. The average is 75% of the commissioned price.✧REVISIONS✧
✧ If your reference is unclear to start with changes will come at an extra charge.
✧ You receive 4 revisions per commission. (Selection pose, main sketch, lineart, and base colors)
✧ Minor adjustments are allowed once the final result, i.e. if I missed any crucial detail from what you requested, What this constitutes is at the artist's discretion. This is the only opportunity you can ask for changes.
✧ Major change requests after final approval/ pre-rendering will incur an additional fee.
✧ Once you approve the final results, you no longer can ask for any changes.✧DEADLINES AND DELIVERY✧
✧ Timeline 1-3 weeks for simple designs based on queue in the order they were received. For more complex items 1-3 months.
✧ You will be updated if any situations change that may hinder progress, such as health, job, technology failures, etc.
✧ Once your commission is finished, you will receive the full-resolution image along with a web-friendly size. Note that there is no physical product.
✧ If for whatever reason you need the commission to be completed sooner than expected, please mention it in the form.✧USE✧
You, the customer/commissioner:
✧ All designs are for personal use only. (unless otherwise agreed upon commercial licensing)
✧ 🚫Do not re-distribute, re-sell, upload to Print on Demand (POD) services, make prints, use AI rendering programs, NFT’s, crypto, or edit the designs. If you are found to violate this rule, you will be blacklisted for commissioning me again.
✧ Not for use on merch unless a previously discussed commercial agreement is made.
✧ You may upload the artwork to social media sites, (such as Bluesky, Discord, Instagram, and Twitch) and your own website, but you must credit me as the artist and link back to the available social media handle @marycreatesart whenever possible.
✧ You may not alter the commissioned artwork without my (the artist's) consent.
✧ You may be allowed to sell the artwork if it is a part of an “Adoptable” listing. Please discuss this with the artist before payment.✧INTELLECTUAL PROPERTY RIGHTS✧
✧ I, the artist, marycreatesart: All copyright ownership is retained by me, the artist, marycreatesart of any artwork produced in the commission, and the client will not have any claim to the artwork's copyright. I will not claim Intellectual property (IP) of the commissioned art.
✧ You, the customer/commissioner:
You retain intellectual property (IP).Copyright Infringement is: Claiming the artwork as your own. Altering artwork without consent. Reproducing/using the artwork commercially for profit without a prior commercial license agreement.✧REFUNDS✧
✧ As stated above, I reserve the right to cancel and refund your commission for any reason including if you the commissioner attempt to falsify or trick me into drawing topics on my will not draw/commission list.
✧ A full refund may be available if I, the artist, am not able to start your commission for any reason.
✧ If you, the commissioner, cancel the order before I have started, you may get a full refund.
✧ If payment is not made within 15 days of project completion, an additional fee will be added on every day and the files will not be delayed until fully paid.
✧ If you request a chargeback at any point when you were not allowed to ask for a refund you will lose all aforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.✧COMMUNICATION: What you get! ✧
✧ What do you get? Communication for insight into planning the piece, including color picking, desired pose, discussion on complexity, etc. Please be clear, it is the responsibility of you (customer/client) to provide as much detail as possible to avoid any miscommunication or misdirection. English is my primary language.
✧ Drafts and mockups
✧ sketch/final sketches
✧ Full resolution file of the final work, and a smaller version made for web social media use. The file is to be PNG unless previously discussed and 300+ dpi whenever applicable ( aside from emotes which require smaller file formats)
✧ Each custom art you order is exclusive to you!

1. Please provide a clear reference with a character description AND one or more of the following:
✧Pose reference (can be a picture or self-drawn; the quality of the drawing does not matter)
✧Environment/atmosphere inspiration
✧Reference sheet
✧Expression reference
✧Clothing reference
✧Any other extra information that you would like to add
2. The character description can include the following:
✧The general appearance of your character
✧Unique physical traits that you would like to see included in the piece
✧Personality that you would like depicted
✧Details that might not be included in the photo/drawing references/I might ask for more details/specifications as needed, so please be ready for those!
3. Lack of References:
✧If you are unable to provide anything else other than a description, I am allowed to raise the prices for you as I see fit, since this is considered character creation rather than simple character sketching/rendering.
✧Otherwise, there is also a high chance that I might have to reject your commission
4. If you ordered a sketch commission, here are a few reminders for you:
✧I may include 1 or 2 prominent flat colors based on your request! (e.g. eye color, hair, significant accessory, et cetera). Please view my gallery or message me for examples.
5. For backgrounds:
✧I usually work with grey backgrounds, but you can request another background color. If there are no explicit or special requests for the appearance of the background, I will include a grey/white and transparent background for you. Solid, gradient, or simple (for rendered) backgrounds Complex backgrounds will incur an additional fee._____________________Once you submit your request, I'll review it to determine if I'm the right fit for your needs. If so, I'll send you a proposal with your exact pricing and timing before we move forward. Please provide as much detail upfront as possible!
